A Canadian law firm HSA reimburses eligible medical expenses within a defined allowance; insurance provides the coverage specified in its policy. Compare actual tax conditions, complete costs and high-cost risk protection. Neither option is automatically cheaper or suitable solely because a lawyer is healthy, self-employed or incorporated.

Use Canadian Reimbursement Rules

A Canadian employer HSA is not a U.S. personal Health Savings Account. It does not establish tax-free personal investment growth, stock or fund holdings, a retirement nest egg, permanent individual ownership or lifetime portability. U.S. high-deductible-plan eligibility tests do not determine Canadian Private Health Services Plan (PHSP) qualification.

Confirm the Employer and Covered People

An incorporated owner must receive the benefit in an employee capacity rather than solely as a shareholder. A solo owner may also be the corporation’s employee; incorporation alone does not settle qualification.

CRA’s archived warning addresses the HSA arrangement described for a sole proprietor without arm’s-length employees. Qualifying self-employed PHSP premiums have separate conditions and limits. Contractors and freelancers should not automatically be treated as employee beneficiaries.

Family coverage depends on actual PHSP covered-person, related-household and plan requirements. A relative does not automatically receive unrestricted coverage or a separate allowance.

Separate Employer and Employee Tax Questions

Qualifying employee PHSP benefits are generally non-taxable federally; Québec has separate provincial taxable-benefit rules. Employer deductions depend on qualifying costs, employment purpose, reasonableness and actual business facts. An unused allowance or deposit alone is not an incurred deduction.

Personal Medical Expense Credits

A personal marginal tax rate is not automatically the corporation’s tax rate.

A personal medical-expense tax credit is a separate calculation with its own period, covered-person and threshold rules. A federal credit threshold is not an HSA allowance or minimum claim. Federally non-taxable reimbursed expenses cannot also support a federal medical-expense credit; qualifying taxable reimbursements included in income and not deducted elsewhere have a separate exception.

Review the Actual Medical Expense

Check the medical category, practitioner recognition in the service jurisdiction, required prescription or certification, other-plan reimbursement and available benefit. A general therapy, wellness, herbal or medical-purpose label does not establish eligibility.

Under the usual drug rule, the medicine must legally require a prescription and the purchase must be recorded by a pharmacist; specific exceptions have their own requirements. Gym memberships and ordinary vitamins or supplements are ineligible even if prescribed, except B12 therapy prescribed for pernicious anaemia.

Separate the Plan Limit From CRA Qualification

There is no single universal CRA annual dollar allowance for every employer HSA. The actual plan can define annual, participant or category limits. An annual cap is not inherently non-compliant, and a tailored plan is not automatically unlimited or more tax-efficient.

Document reasonable employment benefits, covered people, medical categories, periods and deadlines. No allowance range is a universal CRA safe harbour. A medical receipt alone does not establish an unlimited employer obligation.

Favourable PHSP treatment depends on the actual arrangement, including nature of insurance and the all-or-substantially-all test. CRA distinguishes benefits actually paid in a calendar year for a self-insured plan from the premium-based test for an insured plan. An unused allocation is not itself a paid benefit, and the test is not permission to reimburse excluded lifestyle expenses as tax-free medical claims.

Carry-Forward and Deadlines

A qualifying flexible plan may permit either unused credits or eligible expenses to carry forward for up to 12 months, not both. An HSA does not provide a permanent personal investment account, unrestricted portability or a retirement nest egg.

Compare Complete Costs and Protection

Use actual insurance premiums, covered services, category limits, exclusions, deductibles and co-payments. For the HSA, include actual eligible reimbursements, administration, applicable taxes, available allowance and employer funding responsibilities.

Qualifying insured PHSP benefits can also receive favourable federal treatment. Do not assume every insurance plan has a high premium, low deductible or broader eligibility, or that an HSA’s lower spending transfers the same high-cost risks.

The Wellbytes Pay-as-You-Use rate is an administration charge, not the complete benefit cost. A firm may combine insured and HSA benefits, but should identify remaining coverage gaps and coordinate claims rather than promising complete protection.

Review Claims and Retain Evidence

Keep the plan, participant and allowance records, itemized receipts, required medical documentation, other-plan reimbursement decisions, fees, employer funding and payments. Apply actual plan claim periods and carry-forward terms rather than a universal statutory filing deadline.

CRA records generally have a six-year retention period measured from the end of the last tax year they relate to, subject to exceptions. Retention is not a universal seven-year audit window. Follow an actual CRA record request through the permitted secure process.

Claim checks and documentation support accurate administration; they do not establish audit immunity, fewer audits or a guaranteed tax result. A plan label, provider or software tool does not establish CRA approval.

Administration Terms

Under Wellbytes’ current HSA Pay-as-You-Use terms, administration is 10% of eligible reimbursed amounts plus applicable taxes, with no setup or recurring subscription fee. Other arrangements follow their accepted terms. Confirm current digital and support functions rather than assuming payroll integrations, automatic eligibility, instant payment or fewer audits.

Review Wellbytes’ current terms or ask about the employer’s actual proposed benefit.
