A self-employed person’s qualifying PHSP-premium deduction is different from an employer HSA benefit. CRA warns that the personal self-insured HSA arrangement described for sole proprietors without arm’s-length employees does not qualify. An incorporated owner’s benefit also needs an actual qualifying plan and employee rather than shareholder capacity.
Identify the actual arrangement
A sole proprietorship is unincorporated; a corporation is a separate legal entity. That distinction does not by itself settle whether a health benefit or premium qualifies.
Determine whether the proposal is an employment medical benefit or qualifying self-employed Private Health Services Plan (PHSP) premiums. Apply the rules for that arrangement rather than a generic personal HSA contribution allowance.
Check self-employed premium conditions
Income Tax Act section 20.01 includes income, contract, employee and period conditions. In the applicable capped calculation, amounts are $1,500 for each covered adult and $750 for each covered household member under 18, prorated for the covered period. Employee-coverage comparisons can impose a different or lower limit.
These amounts do not give every sole proprietor permission to operate a personal self-insured HSA.
Assess an incorporated owner’s benefit separately
The owner must receive the benefit in employee capacity. Employer deductions depend on actual qualifying business costs, employment purpose and reasonableness; an unused allowance alone is not an incurred deduction.
Qualifying PHSP benefits are generally non-taxable federally to employees. Québec applies separate provincial taxable-benefit rules.
Confirm family coverage and records
A spouse or dependant need not automatically be a separate employee to receive family coverage. Check actual relationship, household and plan requirements.
Retain the contract, covered-person analysis, receipts, required medical evidence, invoices and payments. Records and administration tools do not make an otherwise ineligible cost deductible.
Review the business decision before enrolling
Compare complete costs, insurance protection, reporting and the broader legal and tax effects of the business structure. Incorporation is not a universal cure for an HSA eligibility problem.
Use the actual contract and taxpayer circumstances with the appropriate adviser before claiming a deduction or relying on employee-benefit treatment.
